Confusion as INEC BVAS fails in Osun, Adeleke loses again, tribunal faults umpire over over-voting

THE Bimodal Voters Accreditation System (BVAS) which worked in Anambra to produce Professor Chukwuma Soludo, Edo, to produce Godwin Obaseki, Ekiti, to produce Biodun Oyebanji, eventually failed in Osun to produce Governor Ademola Adeleke as a clear winner of the election, since the election tribunal has voided his mandate, attributing it to over-voting in nine local government areas which INEC allegedly failed to acknowledge before announcing the final result of the election.

If this verdict stands, INEC has a lot of explanations to make to Nigerians on how prepared it is to conduct the general elections beginning with the presidential and national assembly elections on February 25, 2023 since its BVAS can acknowledge over-voting and upload same to the central portal of the agency in Abuja, thereby putting INEC’s claim of a credible election in 2023 to question.

However Governor Adeleke and his party, the PDP, have rejected the ruling of the election tribunal that voided his election and declared his opponent the winner.

He has therefore proceeded to the Court of Appeal to appeal against the ruling of the tribunal.

Though it was a split judgment of two against one, the majority returned Oyetola as governor.

The Advocate News reported how the Osun State Governorship Election tribunal ruled Friday that Gboyega Oyetola of the All Progressives Congress (APC) was the rightful winner of the election.

The tribunal also ordered the electoral commission, INEC, to withdraw the certificate of return issued to Mr Adeleke of the Peoples Democratic Party (PDP) and issue same to Mr Oyetola.

In his reaction, Mr Adeleke called the judgment “a miscarriage of justice.”

According to a statement by his spokesperson, Olawale Rasheed, Mr Adeleke faulted the tribunal’s resolution of the over-voting question in favour of Mr Oyetola, calling it “an unfair interpretation against the will of majority of voters.”

Despite the ruling of the tribunal, Mr Adeleke will remain in office until the higher courts rule on the matter.

The Executive Governor of Osun State, Senator Ademola Adeleke has described the judgement of the governorship tribunal as ” a miscarriage of justice”, vowing to challenge the ruling at the Court of Appeal.

Reacting to the verdict of the Tribunal from his country home, Ede, Governor Adeleke faulted the resolution of the over-voting question in favour of Mr Oyetola, calling it ” an unfair interpretation against the will of majority of voters”

While urging his supporters to remain calm, Governor Adeleke vowed to appeal the judgment at the Court of Appeal, insisting he remains the rightful winner of the July 16 election, 2022.
